Terms and Conditions of AU Bullion South West
1. Interpretation
The following definitions apply within these Terms and Conditions:
Order: A request to purchase precious metals from us.
Products: Precious metals outlined on the order form.
Purchase Price: The amount payable by you for the Products (up to the Investment Amount specified on the order form), inclusive of bid/ask spread and packaging costs.
Storage: Precious metals stored on a fully allocated and segregated basis with comprehensive insurance, subject to relevant charges.

Customer: You.
2. Parties
The customer under these Terms and Conditions is you.
The supplier is AU Bullion South West.

3. Quotations, Orders and Payments
We will provide an initial quotation upfront, which is valid for 24 hours. If you accept the quotation, a sales invoice and order will be produced, and payment will then be taken.
Orders are only confirmed once cleared funds and any required AML documentation have been received.
4. Anti-Money Laundering and Identity Checks
We use TrustID, a third-party provider, to conduct Anti-Money Laundering (AML) and identity verification checks. We will need to verify your identity and permanent address before we will accept instructions to purchase from you. This applies to a single purchase in excess of £5,000 or purchases exceeding £10,000 in any rolling one-year period. Occasions may arise where your ID is requested regardless of your spend. We reserve the right to collect the necessary documentation and run checks to satisfy our legal obligations.
5. Investment Advice
We are not authorised by the Financial Conduct Authority to provide advice comparing precious metals with regulated investments or on potential tax implications. If you require investment or tax advice, you must rely on your own financial, tax, and/or accounting advisers.
6. Delivery
All items will be sent via insured and tracked postage within 24 hours of payment being made, unless specified or requested before a payment is taken. All tracking information will be shared by AU Bullion South West and our chosen courier. All delivery costs are included with any purchase. Ownership of the Products transfers to you upon delivery, provided full payment has been received. We are not liable for any losses due to delivery delays, nor does such delay entitle you to cancel under these Terms and Conditions unless exceeding 28 days after our committed delivery date.
7. Storage Services
We offer storage facilities through a third-party provider. If you wish to store your gold or silver with us, a bespoke storage contract will be drawn up depending on the value of the contents and the duration of storage. This bespoke agreement must be agreed and signed by both parties before a purchase takes place.
8. Risk and Title
Products are at your risk upon delivery. Ownership does not transfer until we receive full payment for the Products.
9. Quality
We warrant that the Products conform to their description as outlined on the order form. All gold is tested by our team before items are shipped. There will not be an example where goods are counterfeit upon arrival as we complete extensive testing beforehand. Therefore, we do not accept goods being returned as counterfeit. If Products do not conform to their description, we may replace them or refund the Purchase Price, provided they are returned at our expense.
10. Assistance with Liquidation of Metals
We do not guarantee a buy-back of your Products. However, we are obliged to help you with an exit strategy to secure the best value possible upon liquidation of your holdings.
11. Selling Precious Metals to Us
You may sell precious metals to AU Bullion South West, subject to the following terms:
The price offered will usually be based on a percentage of the then-current global market spot price for the type and quantity of metal.
If items received differ from those agreed in the offer, we will provide an alternative offer for you to accept or decline.
You warrant that you are the legal owner of the metal and that it meets our selling standards.
You are responsible for packaging, delivery, and related costs unless the items are already stored with us.
Risk remains with you until we confirm receipt and acceptance of the metals.
Payment is normally made on the same day we accept your offer, but may take up to 7 working days for larger transactions or exceptional circumstances.
12. Liability
Our liability is limited to the Purchase Price, except where liability cannot be excluded by law.
13. Cancellation
You have no statutory right to cancel orders or return Products due to fluctuations in precious metal prices. If you terminate your order before dispatch, a termination fee of 20% of the Purchase Price applies, plus any adverse movement in the underlying metal price.
14. Communications
We will ask you to provide your contact details when you place your first order with us. We will use these contact details in relation to all matters conducted for you under these Terms and Conditions unless you advise us otherwise. If your contact details change, it is your duty to notify us in writing. We will then confirm your updated details.
If you wish to allow someone else to act on your behalf, you must provide us with signed confirmation of their authority, along with certified ID and proof of address.
We will contact you using the latest contact details provided by you. If they are out of date, we will not be liable for resulting losses.
Failure to update your contact details may compromise the protections and security we provide, and you will be responsible for any resulting losses.
Communication by email is accepted, but you acknowledge that the internet is not a secure medium. We are not responsible for third-party interception unless caused by our gross negligence.
We do not keep stock on our premises and do not allow unauthorised access. Collections of orders must be arranged in advance at a mutually agreed location, with proof of ID required.
15. General
If any provision of these Terms and Conditions is deemed unenforceable, the remaining provisions shall remain in effect. Our waiver of your breach does not affect future breaches. These Terms and Conditions are not enforceable by any third party. They are governed by English law, and both parties submit to the exclusive jurisdiction of the English courts.
